COOL.STF LICENSE AGREEMENT
COOL.STF ActiveZTERM Beta Release 5

1. LICENSE RIGHTS AND RESTRICTIONS.

COOL.STF grants to you the non-exclusive, non-assignable right to use the ActiveZTERM Beta 5 product in object code form (the "ActiveZTERM Code") on a single computer system. You may not reverse engineer, decompile, or disassemble the ActiveZTERM Code, except to the extent that the foregoing restriction is expressly prohibited by applicable law. You may not rent or lease the ActiveZTERM Code, or otherwise transfer the ActiveZTERM Code and any accompanying written materials. All rights not expressly granted are reserved by COOL.STF.

You agree to the following special beta test license conditions:

• You may not sell, distribute or transfer any portion of the ActiveZTERM Code, including documentation.
• At completion of the beta program, you will be informed by electronic mail to your last known address that the beta has closed. You must then either purchase an ActiveZTERM development license or promptly remove the ActiveZTERM Code from your system.
• Support is via the ZTERM for Windows BBS system only. It's address is http://www.linkkorea.com/bbs/bbs.cgi?id=B0008342. Direct email support of ActiveZTERM is not available during the beta program.

2. PRELIMINARY CODE.

The ActiveZTERM Code provided herein is beta code and not at the level of functionality, performance and compatibility of the final, generally available product offering. The code may be substantially modified prior to first commercial shipment.

3. NO WARRANTIES.

The ActiveZTERM Code and accompanying written materials are provided "as is", without warranty of any kind. To the maximum extent permitted by law, COOL.STF disclaims all warranties, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and noninfringment.The entire risk arising out of the use or performance of the ActiveZTERM Code and any accompanying written materials remains with you.

4. NO LIABILITY FOR CONSEQUENTIAL DAMAGES.

To the maximum extent permitted by applicable law: in no event shall COOL.STF or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of the use of or inability to use the ActiveZTERM Code,even if COOL.STF has been advised of the possibility of such damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.

5. MISCELLANEOUS.

If you acquired this product in the United States, this Agreement is governed by the laws of the State of Maryland. If you acquired this product outside the United States, local law may apply.
If either party employs attorneys to enforce any rights arising out of or relating to this Agreement, the prevailing party shall be entitled to recover reasonable attorneys fees, costs and expenses.
